Remember if this goes to court as an unfair separation case, some people may interpret strong language as evidence of a personal vendetta, or a simple personality clash between you. Usually terminating a jobholder is highly stressful for everyone involved, including the firing boss. This leads to the jobholder feeling you didn't give him his "due." In such cases, suspend the jobholder for 3 days with pay to let everyone's emotions cool off, carry out a fair inquest and prepare a proper dismissal. Written notice: "As I warned you in the previous verbal warning, your [bad behavior] is unacceptable. You'll find out how to get the necessary evidence to fire an employee with a performance and behavior problems. The psychological reason for this meeting is to give the employee a chance to "have his say." He needs to tell someone from management how unfair you and the company have been. Unfortunately, those workforce who make the boss's life the most difficult are more probably to seek legal damages.
